Conditions Générales de Transport
ARTICLE I : Définitions
The terms used in these Conditions of Transport have the following meanings: Interline Agreements (referred to as IIA and MIA) of the INTERNATIONAL AIR TRANSPORT ASSOCIATION (IATA) refer to the reference texts amending certain provisions relating to the liability of the Air Carrier, signed on October 31, 1995, in Kuala Lumpur (IIA) and on April 3, 1996, in Montreal (MIA) applied by Jet Airlines – GuyaneFly by VAN AIR Europe since April 1, 1997, and which are within the legal framework of international texts on Carrier liability (referred to below as the “Warsaw Convention” or “Convention”), as well as the Chicago Convention of December 7, 1944, and its Annexes, particularly Annexes 9, 17, and 18.
Accredited Agent
Refers to a natural or legal person approved by the Carrier to represent it in the sale of air transport tickets for Passengers on the Carrier’s services and, if authorized to do so, on the services of other Carriers.
Voluntary Stopover
Refers to a scheduled stop during the journey, requested by the Passenger, at a stopover located between the point of departure and the point of destination.
Beneficiary (See “person entitled to compensation”)
Refers to articles, effects, and other personal items of a Passenger, intended to be worn or used by them, necessary for their comfort and well-being for the journey.
Unless otherwise provided, this term refers to both the Passenger’s registered and unregistered Baggage. Unless otherwise provided, this term refers to both the Passenger’s registered and unregistered Baggage.
Registered Baggage
Refers to Baggage of which the Carrier takes custody and for which it has issued a Baggage Check.
Unregistered Baggage or “Cabin Baggage”
Refers to any Baggage of the Passenger other than Registered Baggage. This Baggage remains under the custody of the Passenger.
Ticket
Refers to either the document titled “Passenger Ticket and Baggage Check” or the Electronic Ticket issued by the Carrier or on its behalf, which constitutes the Contract of Carriage and includes the Flight Coupons and Notices to Passengers.
Supplementary Ticket
Refers to a Ticket issued for a Passenger, in conjunction with another Ticket, and together they constitute a single Contract of Carriage.
Electronic Ticket
Refers to the Itinerary Receipt (also called Travel Memo) issued by the Carrier in its name, the Electronic Coupon, and, where applicable, the Boarding Pass (CAB).
Baggage Check
Refers to the parts of the Ticket related to the carriage of the Passenger’s registered Baggage.
Carrier Designator Code
Refers to the two or three-letter code that identifies each Carrier.
Contract of Carriage
Refers to the statements contained in the Passenger’s Ticket or in the Ticket wallet, or in the Itinerary Receipt (Travel Memo), clearly identified as contractual provisions and which incorporate these Conditions of Carriage as well as Notices to Passengers.
Convention
Refers to, as applicable:
– The Convention for the Unification of Certain Rules for International Carriage by Air, signed in Warsaw on October 12, 1929;
– The Hague Protocol of September 28, 1955;
– The Guadalajara Convention of September 18, 1961;
– The Montreal Protocols No. 1, 2, and 4 (1975);
– The Convention for the Unification of Certain Rules for International Carriage by Air, signed in Montreal on May 28, 1999.
Coupon
Refers to an Electronic Coupon bearing the name of the Passenger who is to travel on the flight identified on the Coupon.
Passenger Coupon or Passenger Receipt
Refers to the part of the Ticket, issued by or on behalf of the Carrier, which is to be retained by the Passenger.
Flight Coupon
Refers to the part of the Ticket that bears the notation “valid for carriage” or, in the case of an Electronic Ticket, the Electronic Coupon indicating the specific points between which the Passenger is to be carried.
Electronic Coupon
Refers to an electronic Flight Coupon or any other document with value held in the Carrier’s database.
Damage
Covers cases of death, injury, delay, total or partial loss, or other harm as defined in the Convention or below, arising from air transport or related to it or other services provided by the Carrier in the context of air transport.
Special Drawing Rights (SDR)
Refers to the unit of account of the International Monetary Fund (IMF), the value of which is determined periodically by the International Monetary Fund.
Intermediate Stops
Refers to points, other than the points of origin and destination, indicated on the Ticket or mentioned in the Carrier’s timetables as scheduled stops on the Passenger’s itinerary.
Baggage Tag
Refers to a document issued by the Carrier solely for the purpose of identifying registered Baggage.
Itinerary Receipt
Refers to one or more documents that the Carrier issues to the traveler using Electronic Ticketing, which includes the name of the Passenger, flight information, and Notices to Passengers. It may also be called “Travel Memo.”
Days
Refers to the days of the calendar, including all seven days of the week. In the case of notification, the day of sending is not counted. To determine the validity period of a Ticket, the day of the Ticket’s issuance or the day of the start of the flight is not counted.
Travel Memo (See << “Itinerary Receipt”)
Security Item
Refers to any object which, for safety or security reasons, cannot be admitted into the cabin, according to current regulations/legislation.
Passenger
Refers to any person, other than members of the crew, carried or to be carried in an aircraft, with a Ticket.
Person Entitled to Compensation
Refers to the Passenger or any person who may claim compensation for said journey, in accordance with applicable law.
Fares
Refers to the fare, for a transport reserved by the Passenger, in a booking class, for given routes, flights, and dates.
Transport
Refers to the air carriage of Passengers or Baggage, whether free of charge or for a fee, as defined by the Convention (See Convention, above).
Air Transport
Refers, in the context of these terms, to any flight, from the boarding operations to the disembarking operations, in the sense of Article 17 of the Convention.
Air Carrier
Refers to the airline that issued the Ticket, as well as all airlines whose Designator Code appears on the Passenger’s Ticket or on a supplementary Ticket.
Community Air Carrier
Refers to an air carrier holding a valid operating license issued by a Member State, in accordance with the provisions of Council Regulation (EEC) No 2407/92 of July 23, 1992.
Domestic Flight
Refers to any flight where the departure city and destination city are located within the same State, in territorial continuity.
International Flight
Refers, in the sense of the Convention, to any flight for which the point of departure and the point of destination and, possibly, the point of stopover, are located on the territory of at least two States party to the Convention, or within a single State if an intermediate stopover is planned in another State party to the Convention.
ARTICLE II: Scope of Application
l. General
(a) Except as provided in paragraphs 2, 3, and 4 of this Article, these Conditions of Carriage apply to any flight for which the Designator Code of JET AIRLINES/GuyaneFly by VAN AIR Europe appears in the Carrier box of the Ticket or corresponding Coupon.
(b) These Conditions also apply to transportation provided free of charge or at a reduced fare, unless otherwise provided by the Carrier in its regulations, which the Passenger may access, or in contracts, passages, or Tickets issued for such transportation.
(c) These Conditions of Carriage are established in accordance with the Convention and the IATA Interline Agreements, as defined in the above Article.
2. Predominance of Law
These Conditions are applicable to the extent that they are not contrary to the Convention, applicable laws, or filed Fares, in which case, these laws or Fares shall prevail. The possible invalidation of one or more provisions of these Conditions shall not affect the validity of other provisions of these Conditions.
3. Code Sharing
(a) On certain air services, the Carrier has entered into code-sharing agreements with other airlines. As a result, even if the traveler holds a reservation with JET AIRLINES/GuyaneFly by VAN AIR Europe and has a Ticket in which JET AIRLINES/GuyaneFly by VAN AIR Europe is designated as the Carrier by its Carrier Designator Code, the Carrier operating the flight may not be JET AIRLINES/GuyaneFly by VAN AIR Europe.
(b) In this case, and in any similar or related formula (such as block seats or franchise, for example), JET AIRLINES/GuyaneFly by VAN AIR Europe will inform the Passenger before boarding, and the Passenger will benefit from the General Conditions of Carriage of JET AIRLINES/GuyaneFly by VAN AIR Europe, including the liability regime.
4. Predominance of Conditions over Carrier’s Regulations
Unless otherwise provided, in case of contradiction between these Conditions and any other specific regulation of JET AIRLINES/GuyaneFly by VAN AIR Europe not communicated to the Passenger, these Conditions prevail.
5. Charter
If transportation is performed under a charter contract, these Conditions apply only to the extent that they are incorporated, by reference or otherwise, into the Charter Contract or the Ticket.
ARTICLE III: Tickets
l. Necessity of Holding a Ticket
(a) The Carrier agrees to transport a Passenger only if the Passenger possesses a Ticket in their name. The Passenger may be asked by the Carrier to provide appropriate proof of identity.
(b) A Ticket is not transferable. If a Ticket is presented by someone other than the person entitled to transportation or refund for that Ticket, the Carrier will not be responsible for any consequences or outcomes with respect to the holder of the Ticket or any third party if, in good faith, it transports the person holding the Ticket or makes a refund to them.
(c) The Ticket remains at all times the property of the issuing Carrier.
(d) Except in the case of electronic ticketing, transportation on a flight will only be authorized for persons able to present a valid Ticket containing the Coupon corresponding to that flight and all other unused flight Coupons, as well as the Passenger Coupon. The Passenger will not be entitled to transportation if the Ticket presented has been damaged, or if it has been altered by someone other than the Carrier or its Accredited Agent. In the case of electronic ticketing, the Passenger will only be transported on a flight if they produce appropriate identification and if a valid electronic Ticket has been issued in their name.
(e) In case of loss or damage to all or part of the Ticket, or non-presentation of a Ticket containing the Passenger Coupon and all unused flight Coupons, the Carrier that issued the Ticket will replace all or part of this Ticket, upon the Passenger’s request, by issuing a new Ticket, provided that this Carrier receives, at the time of the request, proof that a valid Ticket was issued for the flight(s) in question and that the Passenger gives written agreement to indemnify the Carrier in case of fraudulent use of the Ticket. Otherwise, this Carrier may require the Passenger to pay the price of the replacement Ticket, subject to reimbursement when it is assured that the original Ticket has not been used before the expiration of its validity period. This Carrier may charge the Passenger a reasonable handling fee.
(f) Any traveler benefiting from a fare reduction or a fare with special conditions must be able to justify the validity and regularity of such fare at any time during their journey.
2. Duration of Validity
(a) Subject to the conditions related to the fare paid, a Ticket is valid for transportation for one year from the date of commencement of the journey or, if no part of the Ticket has been used, from its date of issue, unless otherwise indicated on the Ticket, in these Conditions, or in filed Fares.
(b) When a Passenger holding a Ticket is prevented from traveling during the validity period of the Ticket because, at the time they request reservations on a flight, the Carrier is unable to confirm a reservation, the validity of this Ticket will be extended, or the Ticket may be subject to refund, under the conditions of Article X below.
(c) If a Passenger, who has commenced their journey, is prevented, for health reasons, from continuing during the validity period of the Ticket, the Carrier may extend the validity of the Ticket until the date when the Passenger becomes fit to travel, according to a medical certificate that the Passenger must provide to the Carrier, or until the date of the first available flight of the Carrier after such fitness. This extension applies to the journey on which the travel is continued, for transportation in the class of the fare paid. When the remaining flight Coupons in the Ticket, or in the case of electronic ticketing, in the Electronic Coupon, include one or more voluntary stopovers, the validity of this ticket may be extended for no more than three months from the date indicated on the said certificate. Similarly, in the case of a disabled Passenger traveling accompanied, the Carrier will extend the validity of the Tickets of the close family members accompanying this Passenger.
(d) In the event of the death of a Passenger during the journey, the Tickets of persons accompanying the Passenger may be modified by the Carrier either by waiving the minimum stay requirement or by extending the validity of these Tickets. In the event of a death in the immediate family of a Passenger whose journey has commenced, the validity of the Tickets of the Passenger and those of his/her immediate family members traveling with him/her, and proving their degree of kinship, may be modified in the same way. Any modification must be made in exchange for a properly issued death certificate; moreover, the extension of the validity of the Tickets cannot exceed forty-five days from the date of death.
3. Order of Use of Coupons
(a) The Ticket will not be accepted and will lose all validity if all the Coupons have not been used in the order of issuance.
(b) The Ticket is not valid and the Carrier may refuse to honor it if the first flight Coupon or, in the case of electronic ticketing, the Electronic Coupon, corresponding to an international journey has not been used and if the Passenger begins their journey at a voluntary stopover or an intermediate stop.
(c) Each flight Coupon is valid for transportation in the class specified on it, on the date and for the flight corresponding to the reservation made. In the case of a Coupon issued without a reservation, any reservation can be made in accordance with the conditions of the concerned fare and subject to availability of seats on the requested flight.
(d) In the case where the use by the Passenger of their Ticket, according to an itinerary different from that inscribed on the Ticket, would result in a fare difference, the Carrier may, at any time, readjust the amount due by the Passenger to the new applicable fare.
4. Name and Address of the Carrier
The name of the Carrier may appear in abbreviated form on the Ticket, in the form of its Designator Code or in any other form. The address of the Carrier is deemed to be that of the departure airport indicated opposite the name of the Carrier appearing in the
“Carrier” box of the Ticket or, in the case of electronic ticketing, as indicated for the first flight segment of the Carrier in the Itinerary Receipt (or Travel Memo).
ARTICLE IV: Fares and Taxes
- General
The Fares apply only to transportation from the airport at the point of origin to the airport at the point of destination, unless otherwise indicated. The Fares do not include ground transportation between airports and between airports and city terminals, unless it is provided by the Carrier without additional charge. At the time of booking, the Passenger is informed of the total cost of the ticket including taxes, issuance fees, and the overall ticket price (encompassing the total cost including taxes and issuance fees).
- Applicable Fares
Subject to paragraph 4 below, the applicable Fares are those in effect on the date of issuance of the Ticket. Any change by the Passenger in their itinerary or travel dates may affect the price of the trip.

- Itinerary
Unless otherwise provided by the Carrier’s regulations, which the Passenger may access, Fares apply only to the corresponding itineraries. If there are multiple itineraries for which the same fare is applicable, the Passenger may specify, before the issuance of the Ticket, the itinerary they wish to follow. If no itinerary is specified, the Carrier may determine the itinerary itself.
- Fees and Taxes
All fees or taxes imposed by a government, any other authority, or the manager of an airport, relating to the Passenger or the use of any service or means used by them, are added to the Fares and related charges and are payable by the Passenger, unless otherwise provided. They are included in the fare, except if the Carrier was not aware of them sufficiently in advance or if they are too variable to be included as elements of the fare.
- Currency of Payment
Fares and taxes are payable in all currencies accepted by the Carrier, at exchange rates determined by the Carrier at the time of the issuance of the Ticket.
ARTICLE V: Reservations
l. Conditions de réservation
(a) Les réservations ne sont pas confirmées jusqu’à ce qu’elles soient acceptées comme telles et enregistrées par le Transporteur ou son Agent Agréé.
(b) Certains Tarifs peuvent être soumis à des conditions qui limitent ou excluent le droit du Passager de changer ou d’annuler ses réservations
2. Date limite d’émission du Billet
Si un Passager n’a pas effectué le paiement de son Billet (ou conclu un accord de crédit avec le Transporteur) avant la date limite d’émission du Billet, le Transporteur peut annuler la réservation et disposer de la place ainsi libérée.
3. Renseignements personnels
Le Passager reconnaît que des renseignements personnels le concernant ont été donnés au Transporteur dans le but d’effectuer une réservation pour un transport, d’obtenir des services annexes, de fournir des prestations diverses, de faciliter l’accomplissement des formalités administratives relatives à l’immigration et à l’entrée sur le territoire et que ces renseignements peuvent être communiqués à des autorités gouvernementales, à des fins liées exclusivement au voyage du Passager et sous réserve des lois applicables. En conséquence, le Passager autorise le Transporteur à détenir de telles informations et à les transmettre à ses propres agences, à ses Agents Accrédités, à des autorités gouvernementales et aux autres Transporteurs ou prestataires des services ci-dessus mentionnés, quel que soit le pays où ces derniers sont situés. Ces informations sont collectées et traitées conformément à la loi n°78-17 du 06 janvier 1978 modifiée relative à l’informatique, aux fichiers et aux libertés.
4. Attribution des sièges
Le Transporteur s’efforcera d’honorer les demandes d’attribution de siège formulées par le Passager ; toutefois, il ne peut garantir l’attribution d’un siège donné, même si la réservation du Passager est confirmée pour ledit siège. Le Transporteur se réserve le droit de modifier l’attribution des sièges à tout moment.
5. Frais d’annulation pour place inoccupée
Sauf dans le cas des voyages dont les Tarifs ne sont pas remboursables, des frais de dossier d’un montant raisonnable peuvent être facturés au Passager dans le cas où il n’honorerait pas sa réservation. L’annulation est sans frais jusqu’à 72 heures avant le vol, une fois ce délai dépassé, des frais de dossiers de 50€ s’appliquent.
6. Reconfirmation des réservations
Les réservations pour un vol en continuation ou de retour peuvent être soumises à reconfirmation, dans certains délais. Le Transporteur indiquera au Passager s’il requiert une reconfirmation ; toutefois, le Passager devra vérifier si les autres Transporteurs éventuellement impliqués dans le voyage ont des exigences identiques pour les parcours qu’ils assurent. L’inobservation de ces dispositions peut entraîner l’annulation des réservations en continuation ou en retour.
7. Annulation des réservations sur un vol en continuation ou en retour
Si un Passager n’utilise pas une réservation, les réservations pour ses parcours en continuation ou en retour peuvent être annulées par le Transporteur.
ARTICLE VI: Check-In/Boarding
- The Passenger must have completed their check-in formalities sufficiently early before the departure of the flight to comply with the administrative requirements and departure procedures for themselves and their Baggage, but in no case beyond the Check-In Deadline indicated by the Carrier and shown on the Ticket.
- The Passenger must be present at the boarding gate no later than the time indicated by the Carrier.
- If the Passenger does not arrive on time at the Carrier’s check-in counter or boarding gate, or presents with a travel document that does not correspond to the concerned journey, or is therefore not able to travel, particularly under the terms of Article XIII below, the Carrier may cancel the seat reserved for them and dispose of it.
The Carrier’s responsibility for any loss, damage, or expense cannot be sought by the Passenger if they have not complied with the conditions of this Article.
ARTICLE VII: Refusal and Limitation of Transport
- Right to Refuse Carriage
The Carrier may at any point of embarkation and/or transfer, refuse to carry a Passenger or Baggage if it has previously notified the Passenger in writing that it no longer wishes to transport them or if one or more of the following cases has occurred:
- The Passenger has not observed or complied with the laws and regulations in force, as well as the instructions of the Carrier, or has not justified their identity;
- The transport of the Passenger or their Baggage could endanger the safety, health, comfort, or convenience of other Passengers or the crew;
- The physical or mental condition of the Passenger, including a condition caused by the consumption of alcohol or the use of drugs or medication, poses a danger or risk to the Passenger themselves, other Passengers, the crew, or property;
- The Passenger requires special assistance from the Carrier, not previously requested;
- The Passenger has misbehaved on a previous flight, and the Carrier has reason to believe that such conduct may recur;
- The Passenger has refused to undergo security screening or baggage inspection as provided in Articles VIII/5 and Xlll/6 below;
- The applicable fare or all fees or taxes due have not been paid or credit agreements have not been concluded between the Carrier and the Passenger (or person paying the Ticket);
- The Passenger does not appear to possess valid travel documents, attempts to enter a territory where they are only in transit, destroys their travel documents during the flight, refuses to surrender them to the Carrier’s staff upon request and against a receipt, or possesses expired, incomplete, in violation of national or international regulations in force or fraudulent documents (identity theft, forgery, or counterfeiting of documents);
- The Ticket presented by the Passenger:
- has been fraudulently acquired or purchased from an organization not approved by the Carrier other than the Carrier who issued this Ticket or its Authorized Agent; or
- has been listed as lost or stolen; or
- is a falsified or counterfeit Ticket; or
- contains a Flight Coupon that has been tampered with or altered by someone other than the Carrier or its Authorized Agent.
In such cases, the Carrier reserves the right to retain this Ticket.
- In the event that a person presenting a Ticket cannot prove that they are the person named in the “PASSENGER NAME” box, the Carrier reserves the right to retain this ticket and inform the local authorities of the presence of the
- The Passenger has not used their Flight Coupons in order;
- The Passenger has already committed one or more of the acts or omissions described above.
- Special Assistance
- The acceptance of unaccompanied children, disabled persons, pregnant women, and sick persons or any other person requiring special assistance is subject to the prior agreement of the Carrier. Disabled Passengers who have notified the Carrier of their disability or special assistance needs at the time of ticket purchase and have been accepted by the Carrier, with full knowledge, cannot be denied boarding due to their disability or special needs. Unless the disability status provided to the Carrier at the time of booking proves to be inaccurate or inappropriate for the size of the aircraft (cabin access), the Carrier may refuse the Passenger.
- Any Passenger wishing to have a special meal available from the Carrier must inform the Carrier at the time of booking or changing their reservation or within the time frame specified by the Carrier, if any; failing that, the Carrier cannot guarantee the presence of this special meal on the relevant flight. The special conditions referred to in paragraph 2 above are not part of the Contract of Carriage and must be considered as Ancillary Services within the meaning of Article XII below. Furthermore, if a request corresponding to the cases referred to in (a) and (b) above is made at the time of check-in, the Carrier is not responsible if it cannot or has not been able to satisfy it and may even refuse boarding to the concerned Passenger.
ARTICLE VIII: Baggage
l. Baggage Allowance
Passengers may transport Baggage free of charge according to the provisions, and subject to the conditions and limits set out in these Conditions of Carriage, available on request from the Carrier and its Accredited Agents. The Passenger declares to have full knowledge of the contents of each of their Baggage. The Passenger undertakes not to leave their Baggage unattended from the moment it is prepared and not to accept objects from another passenger or any other person. The Passenger undertakes not to travel with Baggage entrusted by a third party.
2. Excess Baggage
The Passenger must pay a supplement for the transport of Baggage exceeding the allowance, at the Rates and conditions provided by the Carrier and available upon request.
3. Items Not Accepted as Baggage
The Passenger must not place in their Baggage:
(a) items not constituting Baggage as defined in Article 1 of these Conditions;
items likely to pose a danger to the aircraft, persons, or property on board,
as specified in the Dangerous Goods Regulations of the International Civil Aviation Organization (ICAO) and the International Air Transport Association (IATA) and
in the Carrier’s regulations, available on request;
(c) items whose transport is prohibited by the laws or regulations in force in any State of departure, destination, overflight, or scheduled stopovers;
(d) items that the Carrier deems due to their weight, size, or nature to be unsuitable for transport;
(e) live animals, except domestic pets and provided that the conditions of paragraph 10 of this Article are respected;
(f) fragile or perishable items, funds, currency, jewelry, art objects, precious metals, silverware, valuables, expensive clothing, optical or photographic devices, electronic or telecommunication equipment, musical instruments, passports and identity documents, samples, business papers, manuscripts or securities, individualized or fungible;
(g) firearms and ammunition other than those intended for hunting or sport or deactivated collectible weapons. To be accepted as registered Baggage, firearms and ammunition for hunting or sport and deactivated collectible weapons must not be loaded, have the safety engaged, and be properly packaged. The transport of ammunition is subject to the Dangerous Goods Regulations of the ICAO and IATA, as indicated in (b) above;
(h) if items mentioned in subparagraphs (a) to (g) of this paragraph are transported, whether their transport as Baggage is prohibited or not, their transport will be subject to the limitations of liability and the provisions of these Conditions of Carriage applicable to the transport of Baggage.
4. Right to Refuse Transport
(a) At any point of embarkation or intermediate, the Carrier may refuse to transport as Baggage the items not admitted, listed in paragraph 3 of this Article, and may also refuse to continue the transport of such items if it discovers them.
(b) The Carrier may refuse to transport as Baggage any item due to its size, shape, weight, content, or nature, or for operational, safety/security reasons, or to preserve the comfort and convenience of Passengers or crew.
5. Right of Inspection
For security/safety reasons, the Carrier may request the Passenger to submit themselves and/or their Baggage to a search or any type of X-ray or other control. If the Passenger is not present or available, their Baggage may be inspected or searched in their absence to verify if they possess, or if their Baggage contains, items referred to in paragraph 3 above, or any weapon or ammunition not presented to the Carrier, under the terms of paragraph 3 (g) above. If the Passenger refuses to comply with such requests, the Carrier may refuse to transport them and their Baggage. If these checks damage the Baggage and its contents or cause Damage to the Passenger, the Carrier is not responsible, except in case of fault or negligence on its part. The Carrier may refuse to transport Baggage for which the Passenger has refused to pay the additional fare.
6. Checked Baggage
(a) When the Passenger hands over their Baggage to the Carrier for check-in, the Carrier takes custody of it and issues a Baggage Tag for each piece of checked Baggage.
(b) If the Carrier deems that the packaging of a Baggage is unsuitable, defective, or in poor condition, it may refuse the Baggage.
(c) The Passenger must affix personal identification to the Baggage before it is accepted by the Carrier.
(d) Checked Baggage is transported, as far as possible, on the same aircraft as the Passenger, unless, for operational or safety/security reasons, the Carrier decides that they will be transported on another flight. If this is the case, the Carrier will deliver the Baggage to the destination of the flight, unless applicable laws require that the Passenger be present for a customs inspection.
7. Unchecked Baggage
The Carrier may impose maximum dimensions for Baggage that the Passenger carries in the cabin and limit the number of them. The Passenger is responsible for their personal effects and unchecked Baggage that they keep in the cabin. In case of destruction, theft, loss, or damage of the Baggage, the Carrier’s liability will be engaged and limited, only if the fault of the carrier is proven by the passenger, to the amount defined in Article XV (2) (c) of these Carrier’s Conditions of Transport.
(a) Baggage that the Passenger carries in the cabin must be placed under the seat in front of the Passenger or in a closed storage space. Items defined by the Carrier as being of excessive weight or size, dangerous for safety, or difficult to store cannot be accepted in the cabin and must be checked in as Checked Baggage.
(b) Items that must not be transported in the hold (such as fragile musical instruments or others) and that do not comply with the provisions of (a) above, can only be accepted for cabin transport if the Carrier has been duly notified in advance and has granted permission. The transport of such items may be subject to a separate fee.
8. Declaration of Value and Collection of Additional Fees
(a) If the Carrier offers this possibility, the Passenger may, for their checked Baggage, declare in writing a value higher than the liability limit indicated in the Convention. In this case, the Passenger may be charged additional fees, at rates set by the Carrier and available upon request.
(b) The Carrier will refuse such a declaration of value if one of the portions of the transport is to be performed by another Carrier that does not offer such a possibility.
9. Retrieval and Delivery of Baggage
(a) The Passenger must retrieve their Baggage as soon as it is made available at the places of destination or voluntary stop If they do not retrieve it within a reasonable time, the Carrier may charge them reasonable storage fees. If the Passenger does not retrieve it within three months from the time it was made available, the Carrier may dispose of it, without incurring any liability towards the passenger.
(b) Only the holder of the Baggage Check and the Baggage Tag issued to the Passenger at the time of Baggage check-in is entitled to retrieve the Baggage. However, the lack of presentation of the Baggage Tag
does not prevent the retrieval of the Baggage, if the Baggage Check is presented and the Baggage can be identified in another way.
(c) If a person claiming a Baggage is unable to produce the Baggage Check and identify the Baggage by means of the Baggage Tag, the Carrier will only deliver the Baggage to this person if they establish their rights to it in a satisfactory manner; at the request of the Carrier, this person must provide sufficient guarantee to indemnify the Carrier for any losses, damages, or expenses that may result from such delivery.
(d) The acceptance of the Baggage by the holder of the Baggage Check, without complaint at the time of delivery, constitutes presumption that the Baggage has been delivered in good condition and in accordance with the Contract of Carriage.
10. Animals
Animals are accepted for transport only in the cabin and not in the hold under the following conditions:
(a) Dogs, cats, birds, and other domestic animals must be properly placed in a ventilated crate and accompanied by valid documents, such as health certificates, vaccination certificates, and entry or transit permits; animals must weigh less than 10kg. If it is a bird, the cage must be covered with a cloth; if it is a rodent, the cage must be metallic.
(b) If accepted as Baggage, the animal transported in its crate, basket, or cage, whose dimensions do not exceed that of a carry-on bag (L+W+H = 110 cm) so as to be placed under the seat. The container must be equipped with an appropriate locking system and ventilation holes. If the animal’s head protrudes, it will be muzzled. Its food is not included in the Passenger’s baggage allowance but constitutes excess baggage, for which the Passenger must pay the applicable rate; the animal remains under the owner’s responsibility throughout the flight and must be kept in its container. The owner and the animal are not placed at emergency exits.
(c) Guide dogs, as well as their crate and food, accompanying blind Passengers and physically disabled Passengers, are transported free of charge, in addition to the normal baggage allowance, in accordance with the Carrier’s Regulations, available upon request.
(d) The Carrier assumes no responsibility for injuries, losses, delays, illnesses, or death of such animals, in the event that entry or transit is refused in a State or territory, as well as for the Damages that such animals might cause to third parties.
ARTICLE IX: Schedules, Delays, Cancellation of Flights
l. Schedules
The Carrier undertakes to do its best to transport the Passenger and their Baggage with diligence and to respect the published schedules in effect on the date of travel. However, the Carrier may be required to use a substitute aircraft or resort to the services of another Carrier. It may also be forced to modify flight schedules for reasons beyond its control and, consequently, the schedules indicated cannot be guaranteed. These schedules are not an element of the Contract of Transport.
2. Cancellation, Rerouting, Delays
If the Carrier cancels a flight or executes it with excessive delays compared to the scheduled time, or does not stop at the voluntary stop or destination of a Passenger, or causes a Passenger to miss a connecting flight, within the limits of a single Contract of Transport on which they had a reservation, the Carrier must, in agreement with the Passenger:
(a) transport the Passenger on another of its regular Passenger flights where a seat is available, without additional charge and, if applicable, extend the validity of the Ticket accordingly; or
(b) reroute the Passenger to the destination indicated on the Ticket, in whole or in part, on its own regular flights or on the regular flights of another Carrier, or by means of surface transport.
3. Compensation for Denied Boarding in Case of Scheduled Overbooking
If, due to scheduled overbooking, the Carrier is unable to allocate a seat to a Passenger holding a confirmed reservation, it will grant compensation, according to the applicable law. If multiple laws or regulations are applicable, the Passenger will benefit from the most favorable.
ARTICLE X: Refunds
l. General
The refund of a Ticket, in whole or in part, will be made in accordance with the laws and regulations in force, and the fare regulation applicable to the Passenger, under the following conditions:
(a) Except as provided in this paragraph, the Carrier is authorized to make the refund to the person who paid for the Ticket, upon presentation by them of sufficient proof of such payment.
(b) If a Ticket has been paid for by someone other than the person whose name appears on the Ticket, and if the Carrier has indicated a restriction on the refund on the Ticket, the Carrier will make the refund to the person who paid for the Ticket or to any person they designate.
(c) Except in the case of a lost Ticket, the refund is made only upon surrender to the Carrier of the Passenger Coupon or Passenger Receipt and all unused flight Coupons.
(d) A refund made to a person presenting the Passenger Coupon or Passenger Receipt and all unused flight Coupons and presenting themselves as the person entitled to the refund under subparagraphs (a) and (b) of this paragraph is considered a proper refund, and the Carrier is discharged from any further liability and any subsequent claim for refund.
2. Involuntary Refund (due to the Carrier)
If the Carrier cancels a flight, does not operate a flight within reasonable limits of the schedule, does not stop at the Passenger’s destination or a scheduled intermediate stop, or causes a Passenger to miss a connecting flight for which the Passenger had a reservation, the amount of the refund will be:
(a) equivalent to the fare paid if no part of the Ticket has been used;
(b) at least the difference between the fare paid and the fare for the transport not performed if part of the Ticket has been used.
3. Voluntary Refund (at the Passenger’s request)
If the Passenger is entitled to a refund of their Ticket for reasons other than those mentioned in paragraph (2) above, the amount of the refund will be:
(a) an amount equivalent to the fare paid, less service and cancellation fees, if no part of the Ticket has been used;
(b) an amount equivalent to the difference between the fare paid and the fare for the journey for which the Ticket has been used, less handling and cancellation fees, if part of the Ticket has been used.
The refunds referred to in this paragraph (3) are not applicable when government regulations or a regulation of the Carrier, applicable to the Passenger, exclude them. This is particularly the case for Tickets marked “non-refundable”.
4. Right to Refuse Refund
The Carrier may refuse a refund:
(a) after the expiration of the validity of the Ticket;
(b) of a Ticket that has been presented to it or to the authorities of a country, as proof of intention to depart from that country. The refund will only be possible if the Passenger provides satisfactory proof that they have permission to stay in that country or that they will leave it through another Carrier, or by other means of transport;
(c) in the case of a Passenger who has not been admitted by the authorities of the destination or of any other point of their journey and is, therefore, returned to their point of embarkation;
(d) in the case of a stolen, forged, or counterfeit transport document;
(e) in a currency different from the one in which the payment for the Ticket was made;
(f) of a Ticket marked “non-refundable”.
5. Currency of Refund
(a) All refunds are made in accordance with the legal or regulatory provisions in force in the country where the Ticket was purchased or in the country where the refund is made. Subject to the above, refunds are normally made in the currency of payment of the Ticket but may also be made in another currency if the Carrier agrees and if the law does not oppose it.
(b) In the case where a refund is accepted by the Carrier in a currency other than the currency of payment, this payment will be made at exchange rates and under the conditions set by the Carrier.
6.Persons Authorized to Refund
Refunds are made only by the issuer of the ticket.
ARTICLE XI: Behavior on Board
l. If the Carrier considers that a Passenger, by their behavior on board, endangers the aircraft, a person or property, prevents the crew from performing their duties, does not comply with the crew’s instructions, particularly those concerning the use of tobacco, alcohol, or drugs, or behaves in a manner that causes or may cause discomfort or inconvenience to other Passengers, the crew, or any property in general, damage, or injury, the Carrier, or its agents may take all necessary measures, including coercive measures, to prevent the continuation of such behavior. This Passenger may be disembarked, denied transport on subsequent journeys at any point in the network, and prosecuted for offenses or any wrongful acts committed on board the aircraft. In this case, the Contract of Carriage is considered unilaterally breached by this passenger.
2. For security reasons, the Carrier may prohibit or limit the use on board the aircraft of electronic equipment such as, but not limited to, mobile phones, laptops, radios, electronic games, transmission equipment, radio-controlled games, and transmitter/receiver sets, as well as any other electronic or recording equipment. However, hearing aids and pacemakers are not included in these categories.
ARTICLE XII: Provisions for Ancillary Services
- Subject to applicable laws, if, as part of a Contract of Transport, the Carrier agrees to make arrangements for the provision of additional services, it will only be responsible to the Passenger for failure to provide, in case of fault attributable to it.
- If the Carrier provides ground transportation services, it will not be responsible for damages to Passengers and their Baggage during transport by road, rail, or sea.
ARTICLE XIII: Administrative Formalities
l. General
(a) The Passenger is responsible for obtaining all necessary documents for their journey, including visas and any special permit required by the legal and regulatory provisions in force in the countries of departure, destination, or transit, and must comply with the requirements of the authorities of these countries regarding immigration and border control.
(b) The Carrier is not responsible for the consequences suffered by a Passenger who has not observed the obligations referred to in (a) above.
2. Travel Documents
(a) The Passenger must present all entry, exit, and transit documents, health documents, and other documents required by the laws or regulations in force in the countries concerned and allow the Carrier to take copies if necessary, at the discretion of the Carrier.
(b) The Carrier reserves the right to refuse transport to any Passenger who has not complied with the laws and regulations in force or whose documents are not in order.
3. Refusal of Entry
If a Passenger is denied admission to a territory, they must pay all costs or fines imposed on the Carrier by the authorities of that country, as well as the cost of transporting the Passenger from that country. The Fares paid by the Passenger to arrive in the country where they were not admitted are not refunded by the Carrier.
4. Passenger’s Responsibility for Fines and Detention Costs
If the Carrier is required to pay or deposit the amount of a fine or penalty or incur expenses of any kind due to the voluntary or involuntary non-compliance by the Passenger with the legal and regulatory provisions of the countries concerned, or the failure to present the required documents, or the presentation of non-compliant documents, the Passenger, at the request of the Carrier, will reimburse all sums paid or deposited and all expenses thus incurred. The Carrier may use for such reimbursements the amounts paid to it for unperformed transport or any sums paid by the Passenger and held by the Carrier.
5. Customs Inspections
If required, the Passenger must attend the inspection of their Baggage, whether checked or not, by customs or any other government authority. The Carrier assumes no responsibility for loss or Damage concerning the Passenger who neglects to observe this provision.
6. Security Checks
The Passenger must submit to all security checks by government or airport authorities or at the request of the Carrier, or any other concerned Carrier. The carrier cannot be held responsible for refusing to transport a Passenger, especially in cases where this refusal is based on the firm belief that the law, regulations, and/or applicable requirements necessitated this refusal.
ARTICLE XIV: Successive Carriers
Transport to be carried out by several successive Carriers, under a single Ticket or several Tickets issued jointly, is considered a single operation, with each Carrier being responsible for the transport it performs on its own.
ARTICLE XV: Liability for Damages
l. General Considerations
Unless otherwise provided by the regulations of JET AIRLINES / GuyaneFly by VAN AIR Europe applicable to Passengers, the responsibility of JET AIRLINES / GuyaneFly by VAN AIR Europe and each Carrier involved in the Passenger’s journey is determined by the Conditions of Carriage of the Carrier that issued the Ticket. When engaged, the responsibility of JET AIRLINES / GuyaneFly by VAN AIR Europe is exercised under the following conditions:
(a) The transport carried out under these Conditions is subject to the liability rules set out by the Convention as well as the IATA Agreements mentioned in Article 1 above and Council Regulation (EC) No 2027 of 9 October 1997 on the liability of the air carrier in the event of an accident;
(b) Except with respect to social protection organizations and similar entities, the Carrier agrees to waive the liability limits set by the Convention in the event of death, injury, or any other bodily injury, when the accident that caused the Damage occurred on board the aircraft or during any boarding or disembarking operations. The liability regime described below is implemented in accordance with the Convention and the IATA Agreements as defined in Article 1 of these General Conditions of Carriage.
(c) To the extent that the following does not conflict with other provisions of these Conditions, and whether or not the Convention is applicable:
(1) the liability of JET AIRLINES / GuyaneFly by VAN AIR Europe is limited to Damage occurring during flights for which its Designator Code appears in the Coupon or the Ticket corresponding to the flight. The Carrier that issues a Ticket or registers Baggage on the lines of another Carrier acts only as an agent of the latter. However, regarding checked Baggage, the Passenger has the right of recourse against the first or the last Carrier;
(II) the liability of JET AIRLINES / GuyaneFly by VAN AIR Europe shall not exceed the amount of proven Damages and, in no case, shall JET AIRLINES / GuyaneFly by VAN AIR Europe be responsible for indirect damages or any form of non-compensatory Damage;
(III) JET AIRLINES / GuyaneFly by VAN AIR Europe assumes no responsibility for Damages resulting from its compliance with any legal or regulatory provisions, or from the Passenger’s non-compliance with the same provisions;
(IV) the exclusions or limitations of liability of JET AIRLINES / GuyaneFly by VAN AIR Europe apply and benefit its Accredited Agents, employees, and representatives of the Carrier and to any person owning the aircraft used by JET AIRLINES / GuyaneFly by VAN AIR Europe, as well as the agents, employees, and representatives of such a person. The total amount recoverable from the aforementioned persons shall not exceed the amount of the liability of JET AIRLINES / GuyaneFly by VAN AIR Europe;
(V) JET AIRLINES / GuyaneFly by VAN AIR Europe assumes no responsibility for Damage to unchecked Baggage unless such Damage is caused by its fault;
(VI) unless expressly provided otherwise, none of the provisions of these Conditions shall waive the limitations or exclusions of liability set forth by the Convention and the laws and regulations in force.
2. Provisions Applicable to International Flights
(a) Bodily Injuries:
(1) Scope of Responsibility of JET AIRLINES / GuyaneFly by VAN AIR Europe:
In accordance with Article 17 of the Convention, JET AIRLINES / GuyaneFly by VAN AIR Europe is responsible for damage in the event of death, injury, or any other bodily injury suffered by a Passenger, when the accident that caused the damage occurred on board the aircraft or during any boarding and disembarking operations and subject to the exemptions from liability specified below;
(II) Exemptions from Liability of JET AIRLINES / GuyaneFly by VAN AIR Europe:
JET AIRLINES / GuyaneFly by VAN AIR Europe is not liable if it proves:
– that the damage in the event of death, injury, or any other bodily injury results from the physical or mental health condition of the Passenger, prior to the moment of boarding by JET AIRLINES / GuyaneFly by VAN AIR Europe;
– that the fault of the injured Passenger caused the damage as per paragraph (a)(i) above or
contributed to it;
– that it took all necessary measures to avoid the occurrence of the damage or was unable to take them, according to Article 20.1 of the Convention.
(III) Waiver of JET AIRLINES / GuyaneFly by VAN AIR Europe:
JET AIRLINES / GuyaneFly by VAN AIR Europe waives the provisions of Article 20.1 of the Convention for any claim for bodily injury from the victim or their dependents whose total amount is less than or equal to the current rate per Passenger;
(IV) Amount of Recoverable Damage:
The amount of liability of JET AIRLINES / GuyaneFly by VAN AIR Europe in the event of death, injury, or any other bodily injury of a Passenger, as per paragraph (a)(i) above, is not subject to any limitation and will be compensated based on the direct assessment of the Passenger’s prejudice by amicable agreement, expertise, or competent courts. In the context of these provisions, JET AIRLINES / GuyaneFly by VAN AIR Europe will only compensate the Passenger
beyond the amounts provided by the social regime to which the Passenger is affiliated.
(v) JJET AIRLINES / GuyaneFly by VAN AIR Europe reserves all rights of recourse and subrogation against any third party.
(VI) In the event of an air accident, as defined in Article 17 of the Convention and paragraph 2(a)(1) of this Article, and in accordance with Council Regulation (EC) No 2027 mentioned above, the person identified as entitled to compensation may receive an advance to meet their immediate needs, in proportion to the material damage suffered, provided that this advance is not less than the equivalent of the current rate per injured traveler, in the event of death. This advance will be paid within 15 days of identification and will be deductible from the final amount of compensation due to the injured Passenger.
(b) Delay:
(1) Characteristics of Recoverable Damage:
Delay in itself is not a source of prejudice; only the direct damage proven to result directly from a delay is recoverable, excluding any indirect damage and any form of non-compensatory damage. The Passenger must establish the Damage resulting from the delay.
(2) Extent of JET AIRLINES / GuyaneFly by VAN AIR Europe’s Liability:
– JET AIRLINES / GuyaneFly by VAN AIR Europe is not responsible for Damage resulting from delay if it proves that it or its agents took all necessary measures to avoid the Damage or that it was impossible for them to take such measures;
– JET AIRLINES / GuyaneFly by VAN AIR Europe is not responsible if the Damage resulting from the delay is attributable to the Passenger.
(3) Extent of Compensation:
– The amount of compensation is based on the Damage proven by the Passenger, within the limits prescribed by the Convention;
– In case of delay in the delivery of checked Baggage, JET AIRLINES / GuyaneFly by VAN AIR Europe may compensate the Passenger for the necessary expenses resulting from the wait for the delivery of the Baggage, when this incident occurs outside the Passenger’s place of residence.
(c) Baggage:
(1) Exemptions from Liability of JET AIRLINES / GuyaneFly by VAN AIR Europe:
JET AIRLINES / GuyaneFly by VAN AIR Europe is not responsible for Damages to a Passenger’s Baggage when these Damages are caused by items contained in said Baggage. Any Passenger whose belongings cause damage to another person or to JET AIRLINES / GuyaneFly by VAN AIR Europe must indemnify JET AIRLINES / GuyaneFly by VAN AIR Europe for the losses suffered and the expenses incurred as a result;
JET AIRLINES / GuyaneFly by VAN AIR Europe incurs special liability, limited to the actual estimated value of the item, as provided in Article 22.2 of the Convention, for Damages and/or loss concerning only the items mentioned in Article VIII/3 above, if the Passenger has made the declaration of value under the conditions provided in Article VIII/8 (a) above and has paid the corresponding additional fees.
(2) Amount of Recoverable Damage:
– For checked Baggage and, except for acts or omissions done with the intention of causing Damage or recklessly, and with the knowledge that Damage would likely result, the liability of JET AIRLINES / GuyaneFly by VAN AIR Europe in case of Damage is limited to the current rates, unless another liability limit is applicable according to the laws and regulations in force. If the weight of a Baggage is not indicated on the Baggage Check, the total weight of the checked Baggage is deemed not to exceed the Baggage allowance authorized for the class of transport concerned, as specified by JET AIRLINES / GuyaneFly by VAN AIR Europe to the Passenger. If a higher value has been declared, in accordance with paragraph 8 (a) of Article VIII, the liability of JET AIRLINES / GuyaneFly by VAN AIR Europe will be limited to this higher declared value.
For unchecked Baggage admitted on board, the liability of JET AIRLINES / GuyaneFly by VAN AIR Europe can only be invoked by the Passenger if they provide proof of the fault of JET AIRLINES / GuyaneFly by VAN AIR Europe. This liability is then limited to the current rates per Passenger.
3. Provisions Applicable to Domestic Flights
(a) For flights within French territory, the regime applicable to JET AIRLINES / GuyaneFly by VAN AIR Europe’s liability for Damage is the same as described for international flights above.
(b) For domestic flights in a State other than France, the regime applicable to JET AIRLINES / GuyaneFly by VAN AIR Europe’s liability for Damage depends on the law or regulation of the concerned State.
ARTICLE XVI: Deadlines for Protests and Liability Actions
l. Notification of Claims for Baggage
The acceptance of the baggage by the holder of the baggage tag without protest is evidence that the baggage has been delivered in good condition, in accordance with the Contract of Carriage, unless proven otherwise by the Passenger. In case of damage to checked baggage (destruction, damage), and in accordance with Article 26 of the Convention, a protest must be made to the Carrier. In this case, the Passenger must protest as soon as they discover the damage and, at the latest, within seven days from the receipt of the baggage. In case of delay, this period is extended to twenty-one days from the day the baggage was made available to the Passenger. Upon receipt of the protest, the Carrier establishes a “damage or loss report,” possibly accompanied by reservations.
2. Liability Action for Passengers
Any action for liability must be brought, under penalty of forfeiture, within two years from the date of arrival at the destination, or from the day the aircraft’s arrival was scheduled, or from the cessation of transport. The method of calculating the period is determined by the law of the court seized.
3. All claims or actions mentioned in paragraphs 1 and 2 above must be made in writing, within the indicated deadlines.
